1. Introduction and Acceptance of Terms
These Terms of Service ("Terms") govern your use of httpsrentmadrio.com (the "Site") and any vehicle rental bookings made through it. The Site is operated by httpsrentmadrio.com, a vehicle rental intermediary serving the Community of Madrid, Spain.
By accessing the Site, submitting a booking enquiry, or completing a reservation, you confirm that you have read, understood, and agree to be bound by these Terms in full. If you do not agree with any part of these Terms, you must not use the Site or place a booking through it.
These Terms apply to all users of the Site, including visitors who browse without booking and customers who complete a reservation. We reserve the right to amend these Terms at any time. Continued use of the Site following any amendment constitutes acceptance of the revised Terms. The date at the top of this page reflects the most recent update.
2. Eligibility Requirements for Vehicle Rental in Madrid
To rent a vehicle through this Site, you must meet the following eligibility criteria at the time of booking and at the point of vehicle collection:
Minimum Age for Car Hire in Madrid
The minimum age to rent a standard vehicle category is 21 years old. Drivers aged 21 to 24 may be subject to a young driver surcharge, which will be clearly stated at the time of booking. Premium, luxury, and large SUV vehicle categories require the primary driver to be at least 25 years old. All age restrictions are assessed at the time of vehicle collection at the Madrid pickup location, whether that is at Madrid Barajas International Airport (MAD), Madrid city centre, or any agreed hotel delivery point.
Driving Licence Requirements
All drivers must hold a full, valid driving licence that has been held for a minimum of one year prior to the rental start date. Driving licences issued by European Union member states are accepted without additional documentation. Drivers holding a licence issued outside the EU are strongly advised to obtain an International Driving Permit (IDP) in addition to their national licence. Some vehicle categories and partner suppliers operating within the Community of Madrid may accept English-language licences without an IDP; however, this varies by provider and we recommend carrying an IDP as standard practice to avoid delays at pickup.
Additional Drivers
Additional drivers may be added to a booking at the time of reservation or at vehicle collection. Each additional driver must satisfy the same age and licence requirements as the primary renter. An additional driver fee may apply and will be disclosed before confirmation of any booking.
3. Bookings, Reservations, and Cancellation Policy
Making a Reservation
All bookings are made through the online reservation system on this Site. Once you submit a booking, you will receive a confirmation email at the address you provide. This confirmation constitutes a binding reservation subject to vehicle availability. It is your responsibility to ensure that all booking details, including pickup date, time, location, and driver information, are correct before confirming your reservation.
No Deposit Booking Policy
A core feature of our service is that no deposit is charged at the time of booking. You are not required to provide a credit card to secure your reservation online. At the point of vehicle collection, you will need to present the payment card used during the booking process alongside a valid driving licence and passport or national ID. This low-commitment approach is designed to make vehicle rental in Madrid accessible to all travellers, including those who prefer to book without a credit card using a debit card.
Free Cancellation Terms
Reservations may be cancelled free of charge up to 48 hours before the scheduled pickup time. Cancellations made within 48 hours of the pickup time may incur a cancellation fee equivalent to one day's rental rate for the vehicle category booked. No-shows - where a driver fails to collect the vehicle at the agreed time and location without prior notice - may result in the full rental value being charged or the loss of a non-refundable booking fee where applicable. Modifications to Bookings
You may request modifications to an existing booking, including changes to the pickup date, return date, or vehicle category, subject to availability at the time of the modification request. Rate differences may apply when upgrading vehicle categories or extending rental periods during peak demand periods such as public holidays in Madrid or the summer season.
4. Pricing, Payment, and Optional Extras
Displayed Pricing and Currency
All prices displayed on the Site are quoted in Euros (EUR) unless otherwise stated. Prices shown at the time of search are indicative and may fluctuate based on real-time availability. The confirmed rate is the rate shown at the point of reservation completion and reflected in your booking confirmation email.
What Is Included in the Rental Rate
Standard vehicle rental rates include the base hire charge for the selected vehicle category, basic Collision Damage Waiver (CDW) coverage, Theft Protection (TP), unlimited mileage where stated in the booking, and local taxes applicable under Spanish law. Any inclusions specific to your booking will be listed in your confirmation documentation.
Optional Extras and Add-ons
The following optional extras are available at the time of booking and may be subject to an additional charge:
- GPS satellite navigation device
- Child seat, baby seat, or booster seat (ISOFIX compatible options available)
- Additional driver registration
- Portable wifi hotspot device
- Upgraded insurance coverage to reduce or eliminate the excess
The cost of each optional extra will be disclosed at the time of selection and included in your total booking amount before confirmation.
Fuel Policy
The standard fuel policy applicable to your rental will be stated in your booking confirmation. In most cases, vehicles are provided with a full tank and must be returned with a full tank. Failure to return the vehicle with the agreed fuel level may result in a refuelling charge plus an associated service fee applied at the point of return. We recommend refuelling before returning the vehicle to any Madrid location, including Madrid Barajas Airport.
5. Permitted and Prohibited Use of Rented Vehicles
Lawful Use Only
All rented vehicles must be used in accordance with the laws of Spain and the regulations of the Community of Madrid. The vehicle must only be operated on public roads that are suitable for the vehicle type. Drivers must comply with all applicable traffic regulations including speed limits on the M-30 ring road, the A-6 motorway towards the Sierra de Guadarrama, and within the Madrid Central low-emission zone (Zona de Bajas Emisiones).
Prohibited Activities
The following activities are strictly prohibited and may result in immediate termination of the rental agreement, recovery of the vehicle, and full liability being passed to the renter for any resulting damage or costs:
- Operating the vehicle off-road or on terrain for which it is not designed
- Use of the vehicle in any form of racing, rallying, time trial, or competitive driving event
- Sub-letting, hiring out, or otherwise allowing any person not listed on the rental agreement to drive the vehicle
- Operating the vehicle under the influence of alcohol, drugs, or any substance that impairs driving ability
- Using the vehicle to transport illegal goods or for any unlawful purpose under Spanish law
- Taking the vehicle outside the agreed geographic territory without prior written authorisation
- Smoking inside the vehicle
Any breach of these prohibited use terms may render any insurance coverage void and the renter personally liable for the full cost of any resulting damage, fines, or third-party claims.
6. Insurance Coverage and Liability Excess
Basic CDW Included in All Bookings
Every vehicle rental arranged through this Site includes basic Collision Damage Waiver (CDW) and Theft Protection (TP) as standard. This coverage limits your financial liability in the event of accidental damage to or theft of the rental vehicle. Basic CDW is subject to an excess amount, which is the maximum sum you may be required to pay in the event of a covered claim. The applicable excess amount for your vehicle category will be stated clearly in your booking confirmation.
Optional Full Coverage to Reduce or Eliminate Excess
You may purchase optional upgraded insurance coverage at the time of booking to reduce or completely eliminate the excess liability. Full coverage options vary by vehicle category and rental duration. We recommend full coverage for drivers who are unfamiliar with driving in central Madrid, particularly in high-traffic areas such as the Gran Via, Paseo de la Castellana, and the approach roads to Madrid Barajas Airport.
Exclusions
Insurance coverage does not apply in the following circumstances: damage resulting from use of the vehicle in breach of these Terms; damage to tyres, wheels, the undercarriage, the roof, or the interior caused by improper use; damage caused while the driver was under the influence of alcohol or drugs; and claims arising from the use of the vehicle outside the agreed rental territory without written authorisation.
7. Limitation of Liability
httpsrentmadrio.com operates as a vehicle rental intermediary and booking platform. The actual rental agreement for the vehicle is between you and the supplying rental operator at the pickup location. As an intermediary, httpsrentmadrio.com is not the owner or operator of the vehicles made available through the Site.
To the fullest extent permitted by applicable Spanish and European Union law, httpsrentmadrio.com shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or from any vehicle rental arranged through it, including but not limited to loss of income, loss of enjoyment, or costs arising from vehicle breakdowns, delays, or accidents. Our aggregate liability in connection with any booking shall not exceed the total amount paid by you for that specific reservation.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded under Spanish consumer protection legislation, including the Real Decreto Legislativo 1/2007 (General Law for the Defence of Consumers and Users).
8. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Spain. Any dispute arising from or in connection with these Terms, or from any vehicle rental booking made through the Site, shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain, unless mandatory provisions of applicable consumer law in your country of residence require otherwise.
If you are a consumer resident in the European Union, you may also have the right to refer disputes to the European Online Dispute Resolution platform operated by the European Commission, accessible at ec.europa.eu/consumers/odr.
